Proposta\u00a0legislativa\u00a0viola\u00a0a\u00a0Constitui\u00e7\u00e3o, p\u00f5e em risco o meio\u00a0ambiente e subordina\u00a0o direito da\u00a0coletividade\u00a0ao direito individual\u00a0dos propriet\u00e1rios em receber\u00a0a\u00a0indeniza\u00e7\u00e3o.<\/p>\n<p>O Minist\u00e9rio P\u00fablico Federal (MPF) divulgou nota\u00a0t\u00e9cnica\u00a0pedindo\u00a0a\u00a0rejei\u00e7\u00e3o\u00a0integral\u00a0do\u00a0Projetode\u00a0Lei\u00a0(PL)\u00a03.751\/2015\u00a0\u2013 que estabelece\u00a0a\u00a0caducidade\u00a0dos\u00a0decretos\u00a0de\u00a0cria\u00e7\u00e3o das Unidades\u00a0de Conserva\u00e7\u00e3o (UCs) caso n\u00e3o tenham sido\u00a0conclu\u00eddos, no prazo\u00a0de\u00a0cinco\u00a0anos, processos\u00a0deindeniza\u00e7\u00e3o\u00a0dos propriet\u00e1rios\u00a0ali situados.\u00a0De\u00a0acordo\u00a0com o MPF,\u00a0a\u00a0proposta\u00a0legislativa\u00a0violav\u00e1rios pontos da\u00a0Constitui\u00e7\u00e3o Federal,\u00a0al\u00e9m\u00a0de\u00a0representar um grave risco \u00e0 preserva\u00e7\u00e3o\u00a0ambiental. O PL tramita\u00a0na\u00a0C\u00e2mara\u00a0dos\u00a0Deputados, na\u00a0Comiss\u00e3o\u00a0de\u00a0Finan\u00e7as e Tributa\u00e7\u00e3o.<\/p>\n<p>Segundo\u00a0o MPF, o ponto considerado\u00a0cr\u00edtico no PL \u00e9\u00a0a\u00a0previs\u00e3o\u00a0de\u00a0extin\u00e7\u00e3o da\u00a0UC quando\u00a0n\u00e3o houver indeniza\u00e7\u00e3o pr\u00e9via\u00a0aos propriet\u00e1rios e\u00a0a\u00a0consequente\u00a0desapropria\u00e7\u00e3o da\u00a0\u00e1rea. Este trecho, esclarece\u00a0a\u00a0nota\u00a0t\u00e9cnica, viola\u00a0expressamente o\u00a0artigo 225, par\u00e1grafo 1\u00ba, inciso III daConstitui\u00e7\u00e3o, segundo\u00a0o qual\u00a0a\u00a0supress\u00e3o\u00a0de\u00a0unidades protegidas s\u00e3o \u201cpermitidas somente\u00a0atrav\u00e9s\u00a0de\u00a0lei, vedada\u00a0qualquer utiliza\u00e7\u00e3o que comprometa\u00a0a\u00a0integridade\u00a0dos\u00a0atributos que justifiquem sua\u00a0prote\u00e7\u00e3o\u201d.<\/p>\n<p>De\u00a0acordo\u00a0com\u00a0a\u00a0nota\u00a0t\u00e9cnica, o PL\u00a03.751\/2015\u00a0tamb\u00e9m\u00a0afronta\u00a0outros dispositivos constitucionais, \u201cpois subordina\u00a0a\u00a0efetividade\u00a0do\u00a0direito\u00a0de\u00a0todaa\u00a0coletividade\u00a0ao meio\u00a0ambiente ecologicamente equilibrado\u00a0ao direito individual e dispon\u00edvel\u00a0de\u00a0propriet\u00e1rios\u00a0de\u00a0receber indeniza\u00e7\u00e3o; imp\u00f5e pondera\u00e7\u00e3o\u00a0de\u00a0direitos\u00a0aparentemente colidentes em clara\u00a0viola\u00e7\u00e3o\u00a0ao postulado\u00a0constitucional da\u00a0proporcionalidade; e\u00a0atenta\u00a0contra\u00a0o\u00a0art. 170, incisos III e IV,\u00a0ao\u00a0afastar os princ\u00edpios da\u00a0fun\u00e7\u00e3o social da\u00a0propriedade\u00a0e da\u00a0defesa\u00a0do\u00a0meio\u00a0ambiente\u201d,\u00a0destaca\u00a0o texto\u00a0assinado\u00a0pelo coordenador daC\u00e2mara\u00a0de\u00a0Meio\u00a0Ambiente e Patrim\u00f4nio Cultural\u00a0do\u00a0MPF (4CCR), subprocurador-geral da\u00a0Rep\u00fablica\u00a0Nivio\u00a0de\u00a0Freitas Silva\u00a0Filho.<\/p>\n<p>O representante\u00a0do\u00a0MPF esclarece que o\u00a0ato\u00a0de\u00a0cria\u00e7\u00e3o\u00a0de\u00a0uma\u00a0UC, em si, n\u00e3o\u00a0altera\u00a0o direito\u00a0de\u00a0propriedade\u00a0dos\u00a0donos\u00a0de\u00a0terras localizadas nessas \u00e1reas protegidas.
